| The University of Alabama in Huntsville (UAH) is in compliance with Principle 3.2.11 because the chief executive officer (the President) has the ultimate responsibility for the athletics program. The three universities of The University of Alabama System share policies related to responsibilities for intercollegiate athletics programs. According to the Board of Trustees of the University of Alabama Board Manual Bylaws, Article V, Section 3, and the UAH Faculty Handbook, Chapter 3, Section 1, the President closely monitors compliance and fiscal matters as stated in the NCAA Manual, Article 6.1.1 and Article 2.1.1. The President exercises appropriate fiscal control over the University's Department of Athletics in the following ways: first, the President reviews and approves the yearly budget for the Department of Athletics. Second, the fiscal activity of the Department of Athletics is subject to the same fiscal requirements as all other departments at the University. It follows the University's annual budget development process and all budget requests for the following year are submitted through the Office of Budgets and Management Information. The President approves the final operating budget of the University. Third, revenues to and expenditures from the Department of Athletics are subject to internal audit. Fourth, all disbursements of gifts are in accordance with polices of the University, with the donor's restrictions, and in compliance with NCAA regulations. As a member of Division II of the NCAA, the Gulf South Conference, and College Hockey America, the University of Alabama in Huntsville abides by rules and regulations of the NCAA and both conferences. The NCAA requires that the President of the University be responsible for certifying that the Department of Athletics' policies, program, and activities are in compliance with NCAA rules and regulations (NCAA Manual, Articles 2.1.1 and 6.1.1). The President's responsibilities over the Department of Athletics are recognized through NCAA rules. According to NCAA Bylaw 30.3, the Certification of Compliance for each institution must be signed by the chief executive officer to certify compliance with NCAA rules. At UAH, the President reviews and signs this report. In the Gulf South Conference, according to GSC Article IV, Section I, the Directors are the Chief Executive Officers (CEOs) at each member institution; and each member institution, through its Director (CEO), is entitled to one vote at any meeting of the Board of Directors. By virtue of this membership in the GSC, the President of UAH is the only voting authority for UAH Athletics at the conference level. UAH has been fully compliant with all requirements. As outlined in the UAH 0rganizational chart, the Director of Athletics reports directly to the President. The supervisory authority of the President is recognized in the Department of Athletics Policies and Procedures Manual. According to this manual, "per the Bylaws of The University of Alabama System, ultimate responsibility for intercollegiate athletics at UAH rests with the President of the University of Alabama in Huntsville." The UAH Athletics Association was formed in 1991. According to its Constitution and Bylaws, the purpose of the Association will be:
Financial reports from the Athletics Association board meetings are filed with the Office of the President of UAH. The Director of Athletics is included as a member of the President's Administrative Council. The President's Administrative Council meets once a month with the President. In addition to the Director of Athletics, those reporting directly to and advising the President on matters related to UAH's Athletics Program are the Intercollegiate Athletics Committee and the Faculty Athletics Representative (FAR). The Intercollegiate Athletics Committee is composed of ten members as follows: Faculty Athletics Representative (Chair), Director of Athletics, one designee from Office of the Vice President for Finance and Administration, one designee from Office of University Advancement, three faculty members elected by the Faculty Senate to serve a staggered two-year term, three students, two of whom will be participating athletes (one male and one female). The Intercollegiate Athletics Committee meets on an ad hoc basis during the academic year. The general job requirement of the FAR is to work closely with the President, faculty, students, Director of Athletics, Director for Athletics Compliance, and other Department of Athletics personnel to support a campus environment in which the athletics program is a vital component of the educational program and in which student athletes constitute an integral part of the student body. The FAR meets regularly with the President and the Director of Athletics. Every five years, NCAA Division II member institutions participate in an NCAA self-study. This self-study is a broad-based question-answer system that helps the University investigate compliance with NCAA rules and regulations. Part of this study includes confirming that the President/CEO is supervising the Director of Athletics. UAH conducted a self-study during 2004. The details of the report demonstrate the direction the President gives to the Director of Athletics. |
